TERMINATION OF MEMBERSHIP AND RE-ADMISSION:
a) Membership may terminate by resignation. A member may at any time resign his/her membership of the association by giving thirty days noticed in writing to the Hony. Secretary after paying all his/her dues to the association.
b) Membership may terminate due to non-payment of subscription. If the subscription is not paid by the last day of April each year, all the privilege of membership will automatically cease. (e.g. Payment made within 30.04.2025 leads to enjoy membership facility from 01.04.2025 to 31.03.2026).
c) Membership may terminate by removal of name on the ground of undesirable conduct as
under:
i) If the conduct of any member is deemed by the Executive Committee prejudicial to the interest of the association, or legally or ethically inappropriate for medical profession, or liable to bring the profession into disrepute, he/she may be requested (not more than two times) by the President to submit a written explanation of his/her conduct. In the event of his/her explanation being found unsatisfactory, the member may be asked to resign from the association. In the event of the said member refusing to resign when asked to do so, his/her name may be removed from the Register if at least three fourths of members present at the General Body Meeting called for the purpose, record their votes for his/her removal.
ii) By removal of name on the ground of conviction in a court of justice: Ipsofacto:
(1) Upon sentence after conviction in a course of justice for any crime entailing moral turpitude.
(2) Upon being deregistered by any Medical Council of India on the grounds of unethical conduct, from that date of deregistration and for the period of deregistration except in case of non-payment of renewal fee in the Registration Council.
(3) Upon forfeiture, through misconduct, of the medical qualification by virtue of which he/she became eligible for membership.
(4) Any legal dispute of any registered member of the Association is subject to jurisdiction of Siliguri court.
d) Re-admission:
i) Any member who has ceased to be a member under clauses 7a and 7b can be re-admitted on fresh application being made by him/her and on payment of all dues outstanding against him/her on that date when he/she had ceased to be a member.
ii) A member, whose name has been removed under clause 7.c.i may be re-admitted on the expiry of 5 years, provided there is no evidence of social or professional misconduct in the interim period. He/she need to submit a written apology along with fresh application of membership acceptable to the executive Committee of the association.
iii) But in case, coming under clause 7.c.ii admission should be possible only after such a Person’s name being reentered in the Medical Registrar. All re-admission, subject to payment of fresh membership subscription in advance as applicable. Membership fee will not be carried forward on termination.
